PREAMBLE

This website ("Site") cuddlecrew.ae belongs to the company Flores & Napstad Co FZE-LLC who is, following the case, whether the owner or the authorized licensee of notably all the related intellectual property rights.

Any reproduction, in whole or in part, of the Site is strictly forbidden unless with the prior written authorization of Flores & Napstad Co FZE-LLC.

These Terms and Conditions ("T&C") are entered into between the company Flores & Napstad Co FZE-LLC ("Cuddlecrew.ae"), whose registered office is at Sharjah, United Arab Emirates under license number 4310340.01, on the one hand, and the persons wishing to book a service or purchase a product via the Site ("User" or "Client"), on the other hand.

The service & products delivery might solely occur within the United Arab Emirates.

The T&C are applicable to any individual who is not acting for his/her industrial, commercial, artisanal, liberal activities.

Cuddlecrew retains the right to adapt or modify, at any time, its T&C. If a modification occurs, the T&C in force at the time of the purchase order will apply. 

T&C ACCEPTANCE
The Client recognizes to be informed of these T&C at the time of his/her purchase order and recognizes to expressly accept them with no reserve. The services and order of a product via the Site implies consequently the acceptance of the T&C with no reserve.

The T&C govern the relationship between Cuddlecrew.ae and the Client and supersede any other terms and conditions.

All Services and product purchase via the Site by the Client are strictly and only for his/her personal use. The Clients and the end users are not authorized to sell back the items whether in whole or in part.

PHOTOS
The photos and other graphic representations on the Site are for illustration only. However, the delivered products will comply with the products on the Site.

SERVICES DETAILS
CuddleCrew, through its website cuddlecrew.ae, provides a range of services to connect users. These services include, but are not limited to, drop-in visit, pet sitting, pet boarding, dog walking, other pets, pet medical administration, pet taxi, pet training and other pet-related activities, collectively referred to as "Services." The CuddleCrew.ae team will share information about individuals and/or entities registered with CuddleCrew.ae to offer pet-related services on their website.

CuddleCrew, via its website cuddlecrew.ae, further expands its services to encompass a pet store, providing users with a variety of pet-related products. Please note that these products may undergo changes, revisions, or updates based on stock availability.

The utmost of care will be given in watching your pet(s). Cuddle Crew will undertake the agreed-on services and the Pet Owner undertakes to provide all necessary information to assist in this performance. Cuddle Crew will provide the services agreed in a reliable, caring and trust worthy manner. In consideration of these services, the Client waives any
and all claims against Cuddle Crew.

Cuddle Crew undertakes to notify the Pet Owner of any occurrence pertaining to the pet(s) which may be relevant to its care and well-being.

CUDDDLE CREW SERVICES 
Drop-in Visits (not more than 1 hour per session), Pet Sitting (more than 1 hour), Stay-in Pet Sitting (minimum 24 hours), In-Home Pet Boarding (your pet at Pet Sitter's Home, minimum 24 hours), Dog Walking (not more than 1 hour per. walk), Pet Training (minimum 1 hour, subject to availability), and Pet Taxi (one-way/two-way, subject to availability).

TRAINING 
You agree to have your dog On and Off lead at your own risk. You agree for Cuddle Crew to use training corrections and techniques when applicable.

PICK UP/DROP OFF 
Whilst there is always the intent to arrive at the allotted time, there is always an hour window of time allowed to pick up and drop off your pet(s) i.e. a 10am pick up can mean any time between 9am and 11am, same goes with the drop off. This is applicable for the "Pet Taxi" service.

REQUIREMENTS 
All pets under the care of Cuddle Crew are to be current on vaccinations, specially anti-rabies. This also includes flea and worm treatments. The Clients will provide suitable harnesses, collars and leads, as well as coats or muzzles if required.  Pet(s) food, drinking water, treats, litter sands, toys, etc. must be provided by the Pet Owners.

As a courtesy to the Pet Sitter and to ensure the Pet Sitter is able to professionally provide services to your pet(s) without inconvenience, Client MUST brief the Pet Sitter, before the start of the service(s), about the pet(s) behavior, allergies, food and water, OTC oral medication if required, schedules for dog walking and potty breaks, play time, etc.. The client must provide all items necessary for pets to be adequately cared for in the client's absence. (I.e., food, medication, bedding, cat litter, water, treats, toys, etc.).  Should pets require any additional supplies whilst in the care of the Pet Sitter, these will be purchased and charged to the Client along with a AED25 surcharge.

PET HEALTH AND BEHAVIOUR
Clients are responsible for providing accurate and up-to-date information regarding their pets' health, behavior, and any special needs. Cuddlecrew reserves the right to refuse or terminate services if a pet exhibits aggressive behavior, poses a safety risk, or has undisclosed health issues that may compromise the well-being of our staff or other pets in our care.

INTELLECTUAL PROPERTY
CuddleCrew.ae is the rightful owner of the website and holds all intellectual property rights associated with it.

CuddleCrew retains exclusive ownership of all intellectual property rights, encompassing but not limited to copyright, trademarks, domain names, design rights, brand elements, database rights, patents, reviews, tertimonials and all other types of intellectual property rights, whether registered or unregistered.

TRADEMARK
All brand elements, company name, website names, logos, registered and unregistered trade-marks displayed on the website or used in connection with the Services are the trade-marks of CuddleCrew.

The use or misuse of trademarks, brand elements, or any other content from CuddleCrew.ae appearing on the website is strictly prohibited, except for those who have obtained permission and consent from CuddleCrew.

RESTRICTIONS ON USE
In addition to complying with these T&C, you agree to use the website and services of CuddleCrew for lawful purposes only and in a manner consistent with all applicable local, national, or international laws and regulations, including all privacy and personal information laws.

The website and any services shall not be used where, and to any extent, such use is prohibited by law. CuddleCrew encourages all Users to report any misconduct, misuse, or unlawful activities of other Users, including, but not limited to, activities on the website and in connection with the services provided.

SOCIAL MEDIA 
The client automatically gives consent for their pet's image to be used in photo or video format on Cuddle Crew social media pages or promotional material.  Clients who do not wish for us to do so, must inform us either verbally or in writing.

DUTIES/SERVICES The Pet Sitter shall not be obliged to perform any other duties except those specified and agreed upon, per this agreement, and/or specified from the "Booking Form". However, simple tasks like “watering the plants” may be accommodated upon discretion by the Pet Sitter.

ACCESS TO PROPERTY Cuddle Crew warrants to keep safe and confidential all keys, remote control entry devices, access codes and personal information of the Pet Owner and to return same to the Pet Owner, as per directed (i.e. leave under the door mat, leave to the guard-on-duty, etc.), at the end of the contract period or immediately upon demand.  

PRICE
Our product & services prices are stated in AED.

Prices mentioned on the website products pages do not include delivery fees. Cuddlecrew retains the right to modify the products or services prices at any time.

However, the price mentioned at the time of the purchase order will remain unchanged and will be charged to the Client.

The price mentioned in the purchase order confirmation is final. It includes all taxes, VAT included.

Although Cuddlecrew makes every effort to ensure that the prices featured on the Site are correct, error may occur. If Cuddlecrew discovers an error in the price of any of the products that the Client have ordered, Cuddlecrew will inform the Client as soon as possible and gives the Client the option of confirming his/her order at the correct price or cancelling it. If Cuddlecrew is unable to contact the Client, the order will be deemed cancelled and all amounts paid will be reimbursed to the Client in full.

PAYMENT TERMS 
The client is responsible for settling the “full payment” for the service(s), minimum 1-2 days prior to the commencement of the assignment. All payments can be acknowledged and receipted if required. In order for Cuddle Crew to facilitate a FREE "Meet & Greet", client must pay in full at least 5-7 days before the service.

The price paid by the Client is the price mentioned on the purchase order confirmation notified by Cuddlecrew.ae.

The Client's purchase order will only be deemed as final once the banks payment centers will have confirmed their agreement. In case of refusal by them, the purchase order will be automatically cancelled and a notification will be sent to the Client by email.

All purchase order confirmation will be notified to the Client after payment confirmation. The Client will also be notified of any purchase order refusal along with the reasons of such refusal.  

BOOKING AND CANCELLATIONS 

To secure services with Cuddlecrew, clients are required to make a booking through our website, cuddlecrew.ae. Cancellation by the Pet Owner of scheduled service(s) with less than 48hrs notice may be charged at the full rate. 

Should the client return early during a booking, full fees are payable. 

Cuddle Crew reserves the right to terminate service at any time before or during pet sits, if the Pet Sitter in its sole discretion, determines that Client’s pet poses a danger to the health or safety of a person or another animal.

DISPUTES

Cuddlecrew cannot be held liable for any damage, whatsoever, resulting from a malfunctioning or a misuse of the products or services. The liability of Cuddlecrew will be, in any case, limited to the purchase order's price. The liability of Cuddlecrew cannot be raised in case of a simple error or omission that could have persisted despite all the precaution taken in respect to the services & products' presentation.

Before taking any court action, a party must use best efforts to resolve any dispute under, or in connection with the Agreement through good faith negotiation. Each party must, to the extent possible, continue to perform its obligations under the Agreement even if there is a dispute.

For any issue, the Client shall contact Cuddlecrw at info@cuddlecrew.ae in order to find an amicable settlement before initiating legal proceedings.

PERSONAL DATA PROTECTION
Keen to ensure the best level of protection for your personal data, Cuddlecrew undertakes to take all measures necessary to process internet Users’ personal data in accordance with the provisions of U.A.E.

An explanation of your rights and comprehensive information on how your personal data is processed by Flores & Napstad Co FZE-LLC ("Cuddlecrew.ae"), is freely available under our Privacy Policy.

TERMINATION 
If either party wish to terminate scheduled ongoing services, parties need to give 7 (seven) days written notice of termination. Cuddle Crew reserves the right to terminate the service at any time, if the Pet Sitter in its sole discretion, determines that Client’s pet poses a danger to the health or safety of the Pet Sitter, any animals or any person. Any wrongful or misleading information in the Pet Owner's or Pet Information sheets may constitute a breach of terms of this Pet Sitting Agreement and can be grounds for instant termination thereof.

Termination under the circumstances described above shall not entitle the Pet Owner to any refunds nor relief of any outstanding payments due.

RETURNS AND REFUND

The Client may return the products within 7 days maximum as from the delivery of the products. However, products which are personalized to the Client's order cannot be returned, except if they are not compliant with the order.

For exchanges or reimbursement requests, clients must return products in their original packaging.

Please email info@cuddlecrew.ae, and a Cuddlecrew representative will provide further guidance.

The Client must take reasonable care of any products that he/she wishes to return and not use them.

Cuddlecrew.ae will not be responsible for any loss or damage caused to the products during their possession by the Client and may reject the request to return, exchange or refund.

The expenses related to the return of the products shall be supported by Cuddlecrew.ae and are identical to those paid at the time of the purchase order.

In case of return of the products, Cuddlecrew.ae will reimburse the Client, free of charge, of all the sums paid, except the expenses related to the return of the products. The reimbursement shall occur within 7 days as from the receipt of the products by Cuddlecrew.ae using the same means of payment as the Client used for the initial transaction, unless agreed otherwise.

In the case of faulty, damaged or incorrectly supplied goods, Cuddlecrew.ae may offer the Client a substitute or replacement product instead of a refund. In any case, the Client must return the faulty, damaged or incorrect products to Cuddlecrew.ae in the same condition as supplied.

It is understood that the products are in conformity with these T&C if they: (i) comply with the description given by Cuddlecrew.ae and possess the qualities that have been presented in the Site; (ii) are fit for the purposes for which goods of this kind are normally used; (iii) show the quality and performance which are normal in goods of the same type and which can reasonably be expected. To the extent permitted by law, Cuddlecrew.ae excludes all warranties, except those that may not be excluded legitimately.

DAMAGES
Cuddle Crew accepts no liability for any breach of security or loss of or damage to the Pet Owner's property if any other person has access to the property during the term of this agreement. Cuddle Crew shall not be liable for any mishap of whatsoever nature which may befall a pet or caused by a pet who has unsupervised access to the outdoors.

It is understood that anyone with access to the home will be notified of Cuddle Crew presence and vice versa. Cuddle Crew reserves the right not refuse entry to any visitors nor pre-authorized and informed about, by the Pet Owner. Cuddle Crew will not be held responsible for any damages incurred to your home or pet(s) by visitors or pre –authorized visitors. The Client agrees to notify Cuddle Crew of any concerns within 24 hours of client’s return home. Cuddle Crew cannot be held responsible for any mishaps, claims, and/or expenses attributed to a destructive or unpredictable behavior of the Client’s pet(s) that cause damage to the Client’s home/property and/or a neighbor’s home/property. (i.e., biting, furniture damage, accidental death, etc. nor can Cuddle Crew be held liable for injury, disappearance, death, or fines of pet(s) with access to the outdoors.

INSURANCE 
Cuddle Crew recommends that all of its clients have adequate pet insurance in place to cover the veterinary care costs in general.

LOSS OR INJURY
The Owner shall be liable for all medical expenses and damages resulting from an injury to the Pet Sitter, any animals or any person caused by the pet as well as damage to any property. Cuddle Crew is not liable for death or injury to any pet in the event of a motor vehicle accident. Cuddle Crew is not liable for loss or injury to any pet. As per the indemnity clause below, Cuddle Crew and Flores & Napstad Co FZE-LLC in general, will not be held responsible.

INDEMNITY 
You agree to indemnify and hold Flores & Napstad Co FZE-LLC, its partners, subsidiaries, affiliates and employees, harmless from any claim, losses, damages, liabilities, actions, suits, proceedings, demands, costs and expenses (including legal and any other professional advisers’ fees), any other liability of whatever nature or description howsoever arising that we suffer as a result or asserted by any 3rd Party due to or arising out and brought against us in connection with: (i) your use of the Services and/or products or any digital platform; or (ii) us acting on or refraining from acting on your instructions; (iii) you or Authorised Users’ actions which are inconsistent with or in breach of the terms of these Terms of Service, Terms and Conditions, Additional Terms, or Applicable Laws.

GENERAL PROVISION Cuddle Crew and Flores & Napstad Co FZE LLC in general, are not liable to the Client for any failure to perform its obligations under the Agreement to the extent caused by Force Majeure, provided that the affected party a) immediately notifies the other party and provides full information about the Force Majeure; b) uses best endeavors to overcome the Force Majeure; and c) continues to perform its obligations as far as practicable.

SEVERABILITY Any illegality, unenforceability or invalidity of a provision of the Agreement does not affect the legality, enforceability or validity of the remaining provisions of the Agreement.

EMERGENCIES In the event of a medical emergency involving a pet, Cuddlecrew reserves the right to seek immediate veterinary attention. If the Client, or the other contact person cannot be reached, the Client agrees to accept any decision Cuddle Crew makes in regard to the pet’s care or Client’s property. The client is responsible for any veterinary bills/cost, no matter how they are incurred, whilst pets are in the care of Cuddle Crew. The Client agrees to reimburse Cuddle Crew for any additional fees for tending to emergency or veterinary care as well as any expenses incurred for same. The Client also agrees to reimburse for additional time accrued at the rate of AED100 per hour in the case of such an emergency.

MODIFICATIONS OF TERMS OF SERVICE 
Cuddle Crew, and Flores & Napstad Co FZE-LLC, may modify or revise any of its Terms of Service, Terms and Conditions, and Additional Terms without notice.  By using the Platform, you are agreeing to be bound by the current version of the Terms of Service, Terms and Conditions, Privacy Policy, and other Additional Terms.

PET RETRIEVAL If a Pet Owner fail to retrieve his/her pet(s) at the end of the service period agreed in a booking, the Pet Owner will be charged for additional service time at the rate established in the booking for each partial late day.

WEBSITE ACCESSIBILITY
We strive to ensure the continuous and reliable availability of our website, but we do not guarantee uninterrupted access, and we reserve the right to modify or discontinue services at our discretion.

Our website may contain links to third-party websites for your convenience. We do not endorse or take responsibility for the content, privacy policy, or practices of these external sites. Users access third-party websites at their own risk.

MISCELLANEOUS
Cuddlecrew acknowledges that individual pets respond differently to pet care, training, and behavior modification efforts. While we strive to provide the best services, we cannot guarantee specific outcomes or results. Factors such as a pet's health, previous experiences, and cooperation play a role in the effectiveness of our services. Clients understand and accept that results may vary, and Cuddlecrew is not liable for any perceived lack of success in training or behaviour modification.

CONSENT
Please note, If you do not consent to all the terms specified in the T&C above, you are prohibited from accessing or using the website. Please refrain from clicking to accept these T&C and discontinue any further proceedings.
